Privacy Policy
Open Book Brewery, LLC (hereinafter referred to as the “Company”) establishes the following privacy policy (hereinafter referred to as the “Policy”) regarding the handling of personal information of users (hereinafter referred to as “Customers”) in relation to the services provided by the Company (hereinafter referred to as the “Services”).
1. Personal Information
In this Policy, “Personal Information” refers to information as defined in the Act on the Protection of Personal Information of Japan (hereinafter referred to as the “Personal Information Protection Act”).
2. Method of Collecting Personal Information
The Company may collect the following types of personal information from Customers in order to provide the Services, or in the course of Customers using the Services:
- Information related to the Customer’s profile, such as name
- Contact information such as email address, phone number, and mailing address
- Payment information such as credit card details, bank account information, electronic payment details
- Other information entered or transmitted by the Customer through input forms or other methods specified by the Company
3. Purpose of Use
The Company collects and uses personal information for the following purposes in connection with the Services:
- To provide and operate the Services, including processing membership registrations, verifying identity, authenticating users, saving user settings, calculating usage fees, and shipping products
- To maintain, protect, and improve the Services
- To notify Customers of new features, updates, new product releases, campaigns, and other information related to the Services, and to respond to inquiries
- To address any violations of the Terms of Service, Privacy Policy, or other related rules
- To inform Customers of any changes to the Company’s Terms, policies, or other related documents
4. Provision of Personal Information to Third Parties
The Company will not provide personal information to any third party (including parties located outside Japan) without the prior consent of the Customer, except in the following cases:
- When required by applicable laws or regulations
- When it is necessary to protect the life, body, or property of an individual and it is difficult to obtain the Customer’s consent
- When it is necessary to cooperate with a government agency, local authority, or party entrusted by such entities in the execution of duties as prescribed by law, and obtaining the Customer’s consent may hinder the execution of such duties
- When the Company entrusts the handling of personal information, in whole or in part, to a third party within the scope necessary to achieve the stated purpose of use
- When personal information is provided as part of a business transfer due to a merger or other similar reason
- In other cases where permitted under the Personal Information Protection Act or other applicable laws and regulations
5. Disclosure of Personal Information
If a Customer requests disclosure of their personal information in accordance with the Personal Information Protection Act, the Company will disclose such information without delay after confirming that the request has been made by the Customer themselves.
However, this does not apply in cases where the Company is not obligated to disclose the information under the Personal Information Protection Act or other applicable laws and regulations.
Please note that a handling fee of 1,000 yen per request will be charged for the disclosure of personal information.
6. Correction and Suspension of Use of Personal Information
- If the Company is requested by a Customer to:
(a) correct their personal information on the grounds that it is not accurate, in accordance with the Personal Information Protection Act; or
(b) suspend the use of their personal information on the grounds that it is being handled beyond the scope of the disclosed purpose of use, or was obtained through deception or other wrongful means,
then, upon confirming that the request has been made by the Customer themselves, the Company shall promptly conduct the necessary investigation and, based on the results, make the correction or suspend the use, and notify the Customer accordingly. If the Company decides not to make the correction or suspend use, it will notify the Customer of that decision. - If a Customer requests the deletion of their personal information, and the Company determines that it is necessary to comply with the request, the Company shall confirm that the request has been made by the Customer themselves, delete the relevant personal information, and notify the Customer accordingly.
- The provisions in paragraphs (1) and (2) above shall not apply in cases where the Company is not legally obligated to correct, delete, or suspend the use of personal information under the Personal Information Protection Act or other applicable laws and regulations.
7. Changes to this Privacy Policy
The Company may update this Policy as necessary.
If any changes are made, the revised Policy will be made available through display on the Company’s website or by other appropriate means, or the Company will notify Customers directly.
8. Use of Cookies
Cookies are small pieces of data exchanged between the browser used by the Customer and the server to enable efficient internet use, and may be stored as files on the Customer’s hard drive.
The Company will not use Cookies in combination with personally identifiable information without prior notice.
Customers can disable Cookies by adjusting their browser settings.
The Company’s website uses Cookies to enhance user experience. Through the use of embedded modules such as Google Analytics, data may be shared with third-party service providers (including those located outside of Japan). This data is collected anonymously and does not identify individuals.
